Nizam: Adopt Good Habits – Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the “Nizam: Adopt Good Habits” application (“App”). Please read these Terms carefully before using the App. By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. General Information

This App aims to help users adopt good habits. It does not provide any medical, psychological, or professional advice, nor is it intended to replace such advice.

2. Use of the App

  1. Age Requirement: You must be at least 13 years old to use the App. If you are under 13, you must use the App under the supervision of a parent or legal guardian. Users under 18 should review and accept these Terms with their parent or legal guardian.
  2. Personal Use: The App is provided only for your personal, non-commercial use. You may not copy, distribute, reproduce, or otherwise use its content for commercial purposes.
  3. Account Responsibility: Any account information (if applicable) you create or use within the App is personal to you. You are responsible for maintaining the confidentiality of your account and password. The developer is not liable for any unauthorized use of your account.

3. Intellectual Property Rights

  1. All texts, graphics, logos, icons, images, audio files, software, and other content (“Content”) within the App are protected by copyright and other intellectual property laws.
  2. You may not copy, reproduce, modify, distribute, or otherwise use the Content without the prior written permission of the developer or the respective rights holders.
  3. “Nizam: Adopt Good Habits” and any other trademarks, logos, or trade names belonging to the developer may not be used without written permission.

4. Fees and Purchases

  1. The App may offer in-app purchases or subscriptions, processed through the Apple App Store. Any fees, billing, refunds, or cancellations are governed by Apple’s own terms and conditions.
  2. Details about existing or future subscription plans are provided within the App or in the Apple App Store listing.

5. User Responsibilities

  1. Accuracy and Updates: You are responsible for any decisions you make based on the information and advice provided within the App. While the developer strives to keep the content accurate and up to date, no guarantee is made regarding its completeness or correctness.
  2. Inappropriate Content and Conduct: You may not post or share any content within the App that is unlawful, harmful, threatening, defamatory, obscene, harassing, or otherwise objectionable, nor engage in such behavior.
  3. Third-Party Links: The App may contain links to third-party websites or services for user convenience. The developer is not responsible for the content or privacy policies of such third-party sites. You access these links at your own risk.

6. Privacy and Data Protection

The collection and processing of your personal data is subject to the developer’s Privacy Policy. Please review the Privacy Policy carefully. By accepting these Terms, you also agree to the provisions of the Privacy Policy.

7. Disclaimer of Warranties

  1. The App and its Content are provided “as is” and “as available,” without any express or implied warranties.
  2. The developer disclaims all warranties, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.
  3. The developer does not guarantee uninterrupted or error-free operation of the App, that defects will be corrected, or that any particular results will be achieved.

8. Limitation of Liability

  1. Under no circumstances shall the developer or its affiliates be liable for any direct, indirect, incidental, special, or punitive damages arising from the use of or inability to use the App.
  2. To the fullest extent permitted by law, the developer’s total liability for any claim related to the use of the App shall not exceed the total amount (if any) paid by you for the App.

9. Changes and Termination

  1. Changes to the Terms: The developer reserves the right to update or revise these Terms at any time. Updated Terms will be posted within the App or on the official website and take effect immediately upon posting.
  2. Service Interruption or Termination: The developer may suspend or discontinue the App, temporarily or permanently, with or without notice, and shall not be liable for any consequences thereof.

10. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or related to them or the App shall be governed by the laws of the Republic of Turkey. All disputes shall be subject to the exclusive jurisdiction of the courts located in Istanbul, Turkey.

Bu Kullanım Şartları (“Şartlar”), “Nizam: Adopt Good Habits” uygulamasına (“Uygulama”) erişiminizi ve kullanımınızı düzenler. Uygulamayı kullanmadan önce lütfen bu Şartları dikkatlice okuyunuz. Uygulamayı indirerek veya kullanarak bu Şartları kabul etmiş sayılırsınız. Bu Şartları kabul etmiyorsanız, lütfen Uygulamayı kullanmayınız.

1. Genel Bilgiler

Bu Uygulama, kullanıcılara iyi alışkanlıklar kazandırmaya yardımcı olmayı amaçlamaktadır. Herhangi bir tıbbi, psikolojik veya profesyonel tavsiye sunmaz ve böyle bir tavsiye yerine geçmez.

2. Uygulama Kullanımı

  1. Yaş Sınırı: Uygulamayı kullanmak için en az 13 yaşında olmanız ya da 13 yaş altındaysanız ebeveyn veya yasal vasinizin gözetiminde olmanız gerekmektedir. 18 yaş altındaki kullanıcıların, bu Şartları ebeveyn veya yasal vasileriyle birlikte inceleyerek kabul etmeleri beklenir.
  2. Kişisel Kullanım: Uygulama, yalnızca kişisel ve ticari olmayan kullanımınız için sunulmaktadır. İçerikleri kopyalayamaz, dağıtamaz, çoğaltamaz veya başka bir biçimde ticari amaçla kullanamazsınız.
  3. Hesap Sorumluluğu: Uygulamayı kullanırken oluşturacağınız hesap bilgileri (varsa) size özeldir. Hesap güvenliğini sağlamak sizin sorumluluğunuzdadır; hesap bilgilerinizin yetkisiz kullanımından geliştirici sorumlu değildir.

3. Fikri Mülkiyet Hakları

  1. Uygulamadaki tüm metinler, grafikler, logolar, simgeler, görseller, ses dosyaları, yazılımlar ve diğer içerikler (“İçerik”), telif hakları ve diğer fikri mülkiyet hakları ile korunmaktadır.
  2. İçeriği, geliştiricinin veya ilgili hak sahiplerinin önceden yazılı izni olmadan kopyalayamaz, çoğaltamaz, değiştiremez, dağıtamaz veya başka bir şekilde kullanamazsınız.
  3. “Nizam: Adopt Good Habits” ve/veya geliştiriciye ait diğer markalar, logolar veya ticari unvanlar, geliştiricinin yazılı izni olmaksızın kullanılamaz.

4. Ücretlendirme ve Satın Alımlar

  1. Uygulama içi satın alımlar veya abonelikler mevcut olabilir. Bu satın alımlar, Apple App Store üzerinden gerçekleştirilir ve ücretlendirme, faturalandırma, iade veya iptal süreçleri Apple’ın kendi şart ve koşullarına tabidir.
  2. Mevcut veya gelecekte sunulabilecek abonelik planları hakkında ayrıntılı bilgi Uygulama içinde veya Apple App Store açıklamalarında belirtilir.

5. Kullanıcı Sorumlulukları

  1. Doğruluk ve Güncellik: Uygulamada yer alan bilgilere ve önerilere dayanarak aldığınız kararlar sizin sorumluluğunuzdadır. Bu bilgilerin kesinliğini ve güncelliğini sağlamak için çaba gösterilse de geliştirici hiçbir garanti vermez.
  2. Uygunsuz İçerik ve Davranış: Uygulamada yasadışı, zararlı, tehdit edici, hakaret içeren, iftira niteliğinde, müstehcen, rahatsız edici veya sakıncalı herhangi bir içerik yayınlayamaz veya bu tür davranışlarda bulunamazsınız.
  3. Üçüncü Taraf Bağlantıları: Uygulama içerisinde üçüncü taraf web sitelerine veya hizmetlere bağlantılar verilebilir. Bu bağlantılar tamamen kullanıcı kolaylığı için sunulur ve geliştirici bu sitelerin içerik veya gizlilik politikalarından sorumlu değildir. Bağlantı verilen siteleri kendi sorumluluğunuzda ziyaret edersiniz.

6. Gizlilik ve Veri Koruması

Kişisel verilerinizin toplanması ve işlenmesi, geliştiricinin Gizlilik Politikasına tabidir. Lütfen Gizlilik Politikası’nı da inceleyiniz. Bu Şartları kabul ederek, Gizlilik Politikası hükümlerini de kabul etmiş olursunuz.

7. Garantilerin Reddi

  1. Uygulama ve İçeriği “olduğu gibi” ve “mevcut olduğu sürece” sunulur; açık veya zımni hiçbir garanti verilmez.
  2. Geliştirici; ticari elverişlilik, belirli bir amaca uygunluk, doğruluk, güvenilirlik veya ihlal etmeme gibi konularda açık veya zımni garanti vermez.
  3. Uygulamanın kesintisiz veya hatasız çalışacağını, hataların düzeltileceğini veya belirli sonuçlar elde edileceğini garanti etmeyiz.

8. Sorumluluğun Sınırlandırılması

  1. Geliştirici veya ilişkili taraflar, Uygulamanın kullanımı veya kullanılamaması ile ilgili doğrudan, dolaylı, tesadüfi, özel veya cezai zararlar da dahil olmak üzere hiçbir zarardan sorumlu tutulamaz.
  2. Yasaların izin verdiği en geniş ölçüde, geliştiricinin toplam sorumluluğu, Uygulamayı kullanmanızdan dolayı oluşabilecek zararlarla sınırlı olup, hiçbir şekilde Uygulama için ödediğiniz toplam tutarı aşmayacaktır (varsa).

9. Değişiklikler ve Fesih

  1. Şartlarda Değişiklik: Geliştirici, bu Şartları herhangi bir zamanda güncelleme veya revize etme hakkını saklı tutar. Böyle bir durumda güncellenmiş Şartlar Uygulama içinde veya resmi internet sitesinde yayınlanır ve yayınlandığı tarihten itibaren geçerlilik kazanır.
  2. Hizmetin Kesilmesi veya Sonlandırılması: Geliştirici, önceden bildirimde bulunarak veya bulunmayarak Uygulamayı geçici veya kalıcı olarak sonlandırabilir. Böyle bir durumda geliştiricinin herhangi bir sorumluluğu bulunmaz.

10. Uygulanacak Hukuk ve Uyuşmazlıkların Çözümü

Bu Şartlar Türkiye Cumhuriyeti kanunlarına tabidir. Bu Şartlardan veya Uygulamadan kaynaklanan veya bunlarla ilgili tüm uyuşmazlıklar, İstanbul (Türkiye) mahkemelerinin münhasır yargı yetkisine tabidir.
